Titipana v IHC South Africa: CCMA retrenchment award
Represented the employee, as stated in Zola Mcaciso’s LinkedIn post
The CCMA found the retrenchment substantively and procedurally unfair and awarded four months’ compensation.
Held
The CCMA found the dismissal substantively and procedurally unfair and ordered R156,000 in compensation, subject to applicable tax.
In an arbitration award dated 7 July 2025, the CCMA found that IHC South Africa (Pty) Ltd had dismissed Tshepiso Titipana for operational requirements without a genuine consensus-seeking process. The commissioner found the economic rationale unsupported and the decision to retrench had effectively already been made.
The award ordered four months’ compensation of R156,000 before applicable tax. Zola Mcaciso shared the signed six-page award and said the firm represented the employee; Gavin Stansfield reposted it. The original document is available below.
