Employment and Labour Relations Amendment Bills, 2025
Two draft Bills published for public comment on 26 February 2026 propose changes to parental leave, on-call work, severance pay and labour dispute processes. They are proposals, not enacted law.
The Department of Employment and Labour published the Employment Laws Amendment Bill, 2025 and the Labour Relations Amendment Bill, 2025 for comment on 26 February 2026.
In its LinkedIn note, MS Inc. identified proposed changes concerning parental leave and UIF benefits, protections for employees with no guaranteed hours, severance pay, and the powers and processes of labour institutions. The firm linked these proposals to the Constitutional Court’s decision in Van Wyk v Minister of Employment and Labour.
The proposals require employers and employees to consider how their contracts and procedures might change if the Bills become law. The text below is the published Gazette; the proposals should not be treated as current statutory requirements.
